By accessing dustydoesmobility.com, using the Dusty Does Mobility mobile app, or using any content provided by Dusty Does Mobility, you agree to these Terms of Service. Please read them carefully.
The Dusty Does Mobility app is a private coaching app for training clients of Dusty Does Mobility. Through the app, clients receive personalized training programs, log workouts, submit check-ins and form-check videos, and communicate with their coach. If you have signed a separate coaching or client agreement with Dusty Does Mobility, that agreement governs your coaching relationship; these Terms apply in addition to it.
The app is intended for adults. Clients under 18 require a parent or guardian agreement with Dusty Does Mobility. When you create an account, you agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that occurs under your account.
Coaching fees, billing schedules, and any commitment periods are set out in your coaching agreement. Payments are processed securely by Stripe, and we never see or store your card details. You can view your billing dates and manage your payment method in the app. For billing questions, contact us at dustydoesmobility@gmail.com.
All mobility content, videos, and written materials on this site and in the app (including personalized training programs) are for informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning any new exercise or mobility program, especially if you have existing injuries or health conditions. Stop any exercise that causes pain and seek professional guidance.
Physical exercise carries inherent risk of injury. By using our programs, site, or app, you voluntarily assume full responsibility for any physical activity you undertake and any risks arising from it.
You own the photos, videos, and information you upload to the app. By uploading, you give Dusty Does Mobility permission to store and use that content solely to provide coaching services to you, as described in our Privacy Policy. Your uploads are visible only to you and your coach.
All content on this site and in the app, including training programs, videos, text, graphics, and branding, is owned by Dusty Does Mobility and protected by applicable copyright laws. Your program is provided for your personal use only. You may not reproduce, distribute, or use our content without prior written permission.
You agree to use the site and app only for lawful purposes. You may not use our content or platform to distribute spam, harmful content, or engage in any activity that violates applicable laws or regulations.
Our content and services are provided "as is" without warranties of any kind, express or implied. We make no guarantees about the accuracy, completeness, or fitness for any particular purpose of the information provided, and no guarantee of specific results from any training program.
To the fullest extent permitted by law, Dusty Does Mobility shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of this site, the app, its content, or any training program.
Our site and app rely on third-party services, including Stripe (payments), Supabase (data hosting), and platforms such as TikTok and YouTube. We are not responsible for the content, privacy practices, or terms of those services.
By subscribing to our email list, you consent to receive periodic communications from Dusty Does Mobility. You may unsubscribe at any time using the link provided in any email.
We may suspend or close accounts that violate these Terms. You may stop using the app at any time; to delete your account and data, see our Privacy Policy. Ending app access does not by itself end any obligations under a separate coaching agreement.
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of the site or app constitutes acceptance of updated terms.
These terms are governed by the laws of the State of Colorado, without regard to conflict of law provisions.
